Please read these Terms of Service carefully before using EZ Tribute. By creating an account, publishing a tribute, or using any feature of eztribute.com, you confirm that you have read, understood, and agreed to every provision below — including all privacy limitations, liability exclusions, and risk disclosures.

Required acknowledgment: When you publish or activate a tribute, you will be asked to confirm via checkbox that you have read and accept these Terms, including all sections on privacy limitations, content responsibility, and online risk. A tribute cannot go live without this confirmation.

1. Who We Are

EZ Tribute is a digital memorial platform operated by Cobra Back LLC. We provide tools for creating and distributing obituaries, invitations, digital sign-in records, and thank-you cards. We are a technology host and display service — we are not a funeral home, legal publisher, or content distributor beyond displaying content on our website.

2. Eligibility

You must be 18 years of age or older to use EZ Tribute. By using the platform, you represent that you have the legal authority to act on behalf of the deceased person's estate or family, and that all information you provide is accurate to the best of your knowledge.

3. Content Accuracy — Your Responsibility

You are solely responsible for the accuracy of all content you submit, including obituary text, dates, names, photos, and service details. EZ Tribute's AI writing tool (EZ Write) assists with drafting — it does not verify facts. You must review and approve all content before it goes live. Once published, errors are visible to anyone with the link. EZ Tribute assumes no liability for factual inaccuracies, misspellings, incorrect dates, or misidentified individuals.

4. Privacy — What You Need to Understand

There is no expectation of complete privacy once a tribute is published. You acknowledge and accept the following:

The deceased person's name, dates, service details, and any content you add to the tribute become accessible to anyone who receives or shares the tribute link. We cannot control who ultimately sees this information.
Your privacy — and the privacy of family members and guests — is limited strictly to what you choose to expose on the platform. EZ Tribute is not responsible for information you choose to include.
EZ Tribute is a host of information, not a distributor. Once a link is created and shared with a guest, delegate, collaborator, or any third party, EZ Tribute has no control over where that link goes or who views it.
Any link shared — whether to an invitation, sign-in form, guest obituary page, collaboration URL, or thank-you card — may be forwarded by the recipient to anyone else. This is the nature of digital links, and EZ Tribute is not responsible for secondary or tertiary sharing of any link we generate.
VIP and Private lists restrict initial access on our platform only. We cannot prevent anyone on those lists from sharing what they see with others outside the list.
EZ Tribute is not responsible if a user, guest, delegate, collaborator, or any other party shares private, VIP, or restricted information with individuals who were not intended to receive it.

5. Photos and Media

Once you upload photos or media to EZ Tribute, they are no longer considered private.

By uploading any image or media file, you acknowledge and agree that:

EZ Tribute will display the image on the tribute page accessible to everyone with the link.
EZ Tribute will not actively share your images with advertisers, third-party databases, or unrelated parties.
However, any individual who has access to the tribute — including guests, delegates, and anyone else who receives the link — may save, download, screenshot, or otherwise reproduce those images. EZ Tribute cannot prevent this and assumes no liability for how images are used by individuals with access to the tribute.
You represent that you have the right to upload all photos and media you submit, and that doing so does not violate the privacy rights or copyright of any person depicted or credited.

6. QR Codes

EZ Tribute generates unique QR codes for tribute sign-in and access. We confirm that our QR codes are genuine and link directly to your tribute on eztribute.com. However, you acknowledge the following:

7. Service Availability and Technology Limitations

We recommend testing all features before the memorial service and having a backup plan for sign-in if internet access is unavailable.

8. Delegates and Collaborators

When you invite a delegate or collaborator, you grant them access to portions of your tribute and potentially to personal information of guests and family members. EZ Tribute is not responsible for actions taken by delegates or collaborators, including unauthorized sharing of access links, editing of content, or misuse of guest information they access through the platform.

9. SMS / Text Message Program

SMS Program: EZ Tribute sends SMS messages for account verification (one-time passcodes), event reminders, and invitation notifications.

How to Enroll: You enroll by providing your mobile phone number on eztribute.com and initiating a login or verification request.

Message Frequency: Varies. Typically 1 message per login attempt. Additional messages may be sent for event reminders.

Message and Data Rates: Msg & data rates may apply. Contact your carrier for plan details.

To Opt Out: Reply STOP to any SMS from EZ Tribute. One final confirmation will be sent.

For Help: Reply HELP or email support@cobraback.org.

No Mobile Sharing: Mobile opt-in data and consent will not be shared with third parties or affiliates for marketing or promotional purposes.

10. Payment and Refunds

EZ Tribute charges a service fee per tribute. All fees are displayed before checkout. Fees are non-refundable once a tribute is created and activated, as digital services are rendered immediately upon activation. Technical issues attributable to EZ Tribute may be considered for credit on a case-by-case basis by contacting support@cobraback.org.

11. User Content Responsibility and Rights

You — not EZ Tribute — are solely responsible for all content you upload or publish.

EZ Tribute cannot and does not verify the source, ownership, accuracy, or appropriateness of any content submitted by users. By submitting any content, you represent, warrant, and agree that:

You have the legal right to upload it. This includes photos, videos, written text, and any other media. If you are uploading images or content that includes other people — living or deceased — you confirm that you have obtained any necessary permissions, or that the use is otherwise lawful.
All information is truthful to the best of your knowledge. You may not knowingly publish false, misleading, or fabricated information about any person, living or deceased. EZ Tribute is not a publisher and does not fact-check content — that responsibility rests entirely with you.
You will not upload copyrighted material without permission. Photos, music, videos, or written works owned by others may not be uploaded unless you hold the rights or a valid license to use them.
You will not upload obscene, offensive, or harmful content. This includes but is not limited to: sexually explicit material, graphic violence, hate speech, content that degrades, mocks, or demeans any person (including the deceased), or any material that a reasonable person would find deeply offensive in the context of a memorial service.
You will not post content intended to harass, defame, or harm any living person. This includes false accusations, revenge content, or anything that could constitute harassment, libel, or slander under applicable law.

EZ Tribute reserves the right to remove any tribute, image, or content that violates these terms or that we determine, at our sole discretion, to be inappropriate — without prior notice and without refund. Repeated violations may result in permanent account suspension.

12. AI-Generated Content

EZ Tribute's EZ Write feature uses artificial intelligence to assist with obituary drafting. AI-generated text may contain errors, assumptions, or phrasing that does not reflect the deceased's actual life or the family's wishes. You must review all AI-generated content before publishing. EZ Tribute assumes no liability for AI-generated content that is published without adequate user review.

13. Online Risk Acknowledgment

By using EZ Tribute, you acknowledge and accept that anything published online carries inherent privacy and security risks. Once content is live on the internet, EZ Tribute cannot guarantee that it will remain entirely private, even with access restrictions in place. You use this service at your own discretion and assume all risks associated with publishing personal and memorial information online.

14. Limitation of Liability

To the fullest extent permitted by law, Cobra Back LLC and EZ Tribute shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, reputational harm, emotional distress, or privacy violations, arising from your use of the platform or from the actions of third parties who access tribute content.

15. Changes to Terms

We may update these Terms at any time. Continued use of EZ Tribute after changes are posted constitutes acceptance of the updated terms.
